Louisville KY Child Custody, Child Support and Visitation Attorney
Issues surrounding your children are always emotional and often hard to discuss. Resources are divided in a divorce and it’s more expensive to support two households than one. Our attorney is skilled at handling the delicate issues of child custody, child support, and child visitation. While you and your spouse can agree to all issues involved in a divorce, the resulting child custody agreement must be approved by the court. Many things are considered by the court in determining the best interests of the children.
Failure by the responsible party to pay financial obligations other than child support is typically a violation of the divorce decree, which usually incorporates the parties’ property settlement agreement as an enforceable order of the court. Enforcing the terms of the property settlement agreement is accomplished by making a motion to the court for the offending party to show cause why they should not be held in contempt of court. An experienced family law attorney knows how to prepare the motion and supporting affidavits, as well as how to meet the deadlines for the family court’s motion hour. Failure to pay child support may be handled either by contempt motion or as a criminal matter, depending on the size of the arrearage and whether the offending party has paid any part of the obligation.
Child support modifications can be requested at any time, but there is a requirement that the proponent show a material change in circumstances that is substantial and continuing. A 15% change in the amount of child support due per month under the Kentucky Child Support Guidelines is rebuttably presumed to be a material change in circumstances, while a less-than-15% change is rebuttably presumed not to be a material change in circumstances.
