Uncontested Divorce

When you go through a divorce or dissolution of marriage proceeding in the state of Kentucky you are going to have to attempt to reach an agreement on the terms with your former partner. If you can find common ground on all of these matters the divorce is said to be uncontested and you won’t be asking the court to settle any disputed points. Below are the issues that you and your former partner would generally need to concur on to be able to move forward with an uncontested divorce.

Property Division

The state of Kentucky uses the “equitable distribution” model to determine how the marital property will be divided between the divorcing parties. This is does not mean that everything will necessarily be split evenly; it will be distributed in a manner that the court considers to be fair. However, if the divorce is uncontested the division of property will not be decided by the court at all. You and your former partner will determine how the property is distributed.

Child Custody, Visitation, and Support

Matters that involve the children must also be decided, and of course this is the most sensitive aspect of the proceeding. People generally act with the best interests of their children at heart when they are discussing these matters, and the fact is that 90% of divorce proceedings are uncontested. In almost all cases an agreement can be reached on these child related issues without battling it out in court.

Spousal Support

Spousal support is a payment made by one former partner to the other, and the term is interchangeable with what is perhaps more commonly known as alimony. It is not always going to be appropriate, but if your divorce is uncontested you will either agree that it is not called for or mutually accept a voluntary spousal support arrangement.

If you are going through a divorce, even if it is uncontested, the wise course of action is to retain the services of a Louisville KY divorce lawyer.
